Welcome to TREMO. These Terms & Conditions (“Terms”) govern your access to and use of the TREMO website, platform, and related services (collectively, the “Service”) operated by TREMO GmbH (“TREMO,” “we,” “us,” or “our”), a company established under the laws of the Federal Republic of Germany, with its registered office at Neue Mainzer Straße 75, 60311 Frankfurt am Main. By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. General Information & Acceptance

These Terms constitute a legally binding agreement between you and TREMO GmbH. We may update these Terms from time to time without prior notice. Any changes will be posted on this page, and the “Last updated” date will be revised. Your continued use of the Service after changes constitute acceptance of the modified Terms.

If you are using TREMO on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.

2. Use of the Service

You agree to use TREMO only for lawful purposes and in accordance with these Terms. You may not:

  • Use the Service in any way that violates applicable local, national, or international laws or regulations (including German and EU law).
  • Attempt to gain unauthorized access to any part of the Service, other accounts, or computer systems.
  • Interfere with or disrupt the integrity or performance of the Service, including introducing viruses, malware, or harmful code.
  • Reverse engineer, decompile, or disassemble any portion of the TREMO platform.
  • Use automated scripts or bots to scrape, extract, or collect data from the Service without our explicit consent.

3. Account Registration & Security

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to update it as necessary. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. TREMO reserves the right to suspend or terminate accounts that violate these Terms or pose a security risk.

4. Intellectual Property & Content

All content, features, and functionality on the TREMO website and platform — including but not limited to text, graphics, logos, icons, images, audio clips, data compilations, and software — are the exclusive property of TREMO GmbH or its licensors and are protected by international copyright, trademark, and intellectual property laws, including those of Germany and the European Union.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any part of the Service without prior written permission from TREMO. The TREMO name and logo are registered trademarks.

User Data & Submissions

By connecting your Facebook Ads accounts and CRM systems, you grant TREMO a limited license to access, process, and display your data solely for the purpose of providing the Service. You retain all ownership rights to your data. We do not claim ownership over any of your business information, ad performance data, or CRM records. However, you represent that you have the necessary rights and permissions to connect such third-party services to TREMO.

5. Privacy & Data Protection (GDPR Compliant)

Your privacy is fundamental. Our Privacy Policy explains how we collect, use, and protect your personal information in accordance with the EU General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG). By using TREMO, you consent to our data practices as described in the Privacy Policy.

6. Third-Party Integrations & Links

TREMO integrates with third-party services such as Facebook Marketing API, various CRM platforms (Salesforce, HubSpot, amoCRM, etc.), and analytics tools. We do not control these third-party services, and your use of them may be subject to their own terms and policies. TREMO is not liable for any actions, data breaches, or failures arising from third-party integrations.

Our website may contain links to external websites. We provide these links for convenience and do not endorse or assume responsibility for their content or practices.

7. Fees, Subscriptions & Payments

Certain parts of TREMO are offered on a subscription basis (e.g., Pro Plan). All fees are clearly displayed during sign-up. Subscriptions automatically renew unless canceled before the renewal date. You authorize us to charge the payment method on file. All payments are processed in accordance with German commercial law. We reserve the right to modify pricing with reasonable notice, which will be communicated via email or platform notification.

8. Cancellation & Termination

You may cancel your account at any time by contacting support or via account settings (if available). TREMO may suspend or terminate your access without notice if you breach these Terms or engage in conduct that harms the platform or other users. Upon termination, your right to use the Service ceases, and we may delete your data in accordance with our data retention policy and applicable data protection laws.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TREMO DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES. WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee specific results from using TREMO, including any return on ad spend (ROAS) or business outcomes. Decisions based on platform analytics are your sole responsibility.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY GERMAN AND EU LAW, TREMO GMBH, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability shall not exceed the amount you paid us during the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless TREMO GmbH and its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Service; (b) any violation of these Terms; (c) your connection of third-party accounts; or (d) any infringement of third-party rights by your content or actions.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law principles. The exclusive place of jurisdiction for all disputes arising from or in connection with these Terms shall be Frankfurt am Main, Germany, provided you are a merchant, a legal entity under public law, or have no general place of jurisdiction in Germany. For consumers, the statutory provisions apply.

13. GDPR & EU Rights

As a data controller (for account information) and data processor (for customer data), TREMO complies with the General Data Protection Regulation (GDPR). If you are located in the European Economic Area (EEA) or Switzerland, you have specific rights, including the right to access, rectification, erasure, restriction of processing, data portability, and the right to lodge a complaint with a supervisory authority (such as the Hessian Commissioner for Data Protection and Freedom of Information in Germany).

14. Miscellaneous

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision does not constitute a waiver of such right. These Terms constitute the entire agreement between you and TREMO regarding the Service.
